Legal Assistance (Conveyancing)

At Don Russell Homes we understand that the first time you buy a residential property in Perth the paperwork can be a little confusing. We can help you establish a relationship with a conveyancer.

The conveyancer can provide you with a huge amount of advice on the process, timeframes and help guide you through the process from purchase to ownership. The role of the conveyancer is to assist you and answer any queries you have as well as making sure everyone is doing what they should when they should, including you. Having a conveyancer who is patient and understanding and who doesn’t mind you emailing, ringing twice or ten times a day will alleviate some of the stress that some first investors or home buyers experience.

The conveyancer who we recommend has been looking after out overseas clients for the last 18 years.

What does a conveyancer do?

  1. Upon receipt of the purchase Contract, the paperwork is thoroughly checked to ensure all is in order. A file is created and the conveyancer will send you an Appointment to Act.
  2. Once your purchase contract is unconditional, the conveyancer will arrange for the title to be searched and further investigate any encumbrances such as restrictive covenants, easements, caveats etc, in order that they may be removed upon settlement or the new owner will be advised of their existence and how they affect the land.
  3. The conveyancer will liaise with all parties in the transaction. The conveyancer will conduct regular follow ups and make sure that everyone involved in the transaction iis doing what they should be doing.
  4. Prepare all necessary documentation for you to sign, including a settlement statement that will either apportion current rates and taxes or include an amount to be held in trust pending receipt of the relevant accounts and attend to the stamping of the land transfer.
  5. Liaise with your bank if finance is being used for your purchase.
  6. Follow up on all special conditions relating to the offer and acceptance to ensure conditions are met and continually follow-up all those involved in the settlement to avoid any delays.
  7. The conveyancer will arrange and attend settlement exchanging documents and disbursing funds in accordance with your instructions and ensuring that the documents are registered with the Land Titles Office.
  8. The conveyancer will keep you informed at all times of the progress of the settlement.
  9. The conveyancer will advise local authorities for water, gas, power and local council, of the change of ownership

Overseas and Interstate Buyers should note:

  • There is no cooling off period
  • There is no “exchange” of contract in WA
  • There are no compulsory Seller disclosure requirements in WA except for the sale of Strata Lots.
  • Contracts in WA are usually completed by the Real Estate Agent, signed by the Buyer and then presented to the Seller for acceptance. Once the Seller has accepted the offer the contract is “exchanged”.
  • It is considered prudent to allow additional time for Settlement, as documents will need to be sent to you for execution.
  • For overseas Buyers take care when completing your details on the Contract and ensure that you check the spelling and order of your names is as per your passport.
